Copyright & DMCA Policy

Copyright & DMCA Infringement Policy for Araplay
Date of Entry into Force: June 2026

1. Legal Framework and Commitment to Intellectual Property

Axios AB, the operating entity and owner of the Araplay digital platform, strictly respects the intellectual property rights, copyrights, and neighboring rights of all content producers, distributors, broadcasters, and television networks. This Policy has been formulated in absolute compliance with the Swedish Copyright Act (Lag (1960:729) om upphovsrätt till litterära och konstnärliga verk), applicable European Union intellectual property directives, and the Digital Millennium Copyright Act (DMCA).

2. Nature of Service and Technical Safe Harbor Disclaimer

The Araplay platform operates strictly as a technical host and digital distributor for the transmission and delivery of licensed, authorized audiovisual content within its designated geographical territory. In accordance with Swedish and European Union e-commerce regulations governing online service providers and technical hosts, Axios AB is fully protected under the "Safe Harbor" immunity framework. The Company is committed to reviewing and addressing formal copyright claims submitted through the authorized official channels detailed below swiftly, without assuming any pre-calculated, proactive legal or financial liability.

3. Strict Verification Requirements for Filing a Copyright Infringement Notice

If a competing entity, third party, or authorized legal counsel claims that unauthorized content is being streamed via the Araplay platform, a formal, legally binding written notice must be submitted. To prevent anonymous or malicious interference, Axios AB will discard any notice that fails to provide all the following components in their entirety:

  • A physical or electronic signature of the copyright owner or the legally appointed counsel authorized to act on the owner's behalf.
  • A precise and exclusive identification of the copyrighted work or broadcast channel claimed to have been infringed, along with official proof of ownership or valid broadcasting titles.
  • Complete, verified corporate contact information of the complaining party (Full corporate name, commercial registration number / organisationsnummer, physical registered address, and official corporate email address).
  • A formal statement that the complaining party has a good-faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.
  • A declaration made under penalty of perjury and false accusation statutes that the information contained within the notification is accurate and that the complaining party is the exclusive rights holder or is legally authorized to act on their behalf.
4. Exclusive Official Channel for Legal Notices

All notices and formal claims regarding intellectual property and copyright infringements must be transmitted directly to the Legal Department of Axios AB via the Platform's exclusive, dedicated email address:

Email Address: copyright@araplay.se

(Critical Legal Notice: Any complaints or notifications transmitted through regular customer technical support channels, social media platforms, or from free, non-corporate email services—such as Gmail, Outlook, or Hotmail—will be completely disregarded and deemed legally void. This clause serves as a material baseline defense before Swedish courts).

5. Investigation and Take-Down Procedure

Upon receipt of a legally sound, fully compliant infringement notice matching all conditions outlined in Section 3, Araplay will execute the following protocols:

5.1 Preliminary Legal and Technical Review: The Legal Department of Axios AB will evaluate the claim and verify the submitted title documentation within a maximum period of 48 hours from the time of formal receipt.

5.2 Temporary Suspension: If the initial claim is deemed substantial and a valid broadcast license cannot be verified for the disputed stream, the feed will be temporarily suspended or isolated from the Platform's core servers and Content Delivery Networks (Hetzner / Google Cloud) during the ongoing investigation.

5.3 Counter-Notice Execution: The content provider will be notified immediately of the temporary suspension and retains the absolute right to file a formal Counter-Notice backed by valid licensing documentation to instantly re-activate the stream.

6. Anti-Malicious Claim Protections, Punitive Damages, and Legal Prosecution of Competitors

6.1 Criminalization of Fraudulent Notices: Any party submitting an infringement notice through this page explicitly acknowledges and agrees that filing false, misleading, unverified, or malicious copyright claims without absolute, definitive statutory backing is an illegal act that triggers severe civil and criminal liabilities under both Swedish law and the DMCA.

6.2 Targeted Legal Prosecution of Competitors: In the event that a competing business, platform, or hostile third party abuses this mechanism or submits fraudulent claims with the malicious intent to harm Araplay's commercial operations, block its channels, or disrupt its server infrastructures, Axios AB will initiate immediate, aggressive legal actions against the complaining party before competent Swedish courts without prior warning.

6.3 Scale of Financial Damage and Restitution Claims: Axios AB reserves its full statutory rights to legally compel any entity filing a malicious or fraudulent claim to pay comprehensive, direct financial damages and compensation, which shall include:

  • a) Complete restitution for lost commercial profits (Förlorad vinst) resulting from the suspension of the digital streams.
  • b) Substantial punitive financial compensation for damages caused to the platform's commercial reputation, brand goodwill, and user base.
  • c) Full coverage of all legal expenditures, defense bills, court costs, and hourly attorney fees incurred by Axios AB.
